SENTANCE VOIDED IN TEEN SEX CASE

Today...a man sentenced to 10 years in prison for consensual oral sex has had his sentance voided. Genarlow Wilson was 17 when the act took place on a 15-year old girl. This sentance has been widely criticized as being grossly disproportionate to the crime. Even though his sentance has been voided, his freedom hasn't been ensured. Georgia's Attorney General, Thurbert Baker has filed a notice of appeal. He's stating that Georgia law doesn't give a judge authority to reduce or modify a sentance imposed by a trial court. Baker is seeking an expedited ruling from the Georgia Supreme Court. Wilson, 21, will not be released until the department receives guidance from the state's attorney general's office or from the original court that sentanced him. Wilson's lawyer will be applying for a bond to release him while the appeal is pending.
Wilson's 10-year sentance was thrown out amending it to a misdemeanor aggravated child molestation with a 12-month term, plus credit for time served, with no need to register as a sex offender.

- Okay, I see it this way. It was consensual ORAL sex, no penetration..... this is kinda ridiculous. Its like saying that every teenager out there can be arrested for having sex with another teenager. I could see if the teen was 17 and the other was like 13, but this was a 15-year old. By the time you are 15....I think most people are capable of making decisions concerning sex. Also, its not like she objected...she consented to it...she willingly participated in a sexual act with a boy who was only 2 years older than her. They were both minors....In my opinion...he shouldn't be charged with anything.
